Modern scientific library and copyright: how not to violate the law

Abstract: The article deals with the challenges faced by library as a social institution, which aims to provide universal access to information following the Law of Ukraine «On Copyright and Related Rights». The essence of the problem, according to the author, is the contradiction that arises between this law and the Law of Ukraine «On Libraries and Librarianship», which defines the basis of state policy in the field of librarianship as realization of citizens’ right to library services, providing general availability of information and cultural values. The article author emphasises that copyright protection should not be a barrier to library collections access and refers to the recommendations and official IFLA position on copyright in the electronic environment. In the article introduction the attention is drawn to the relevance of the problems concerning relations legal regulation between authors (publishers), library users and library in the circumstances of Ukraine integration into the European economic, political and legal space. In the main part the author analyses the current legislation of Ukraine on copyright and those exceptions made by the Law of Ukraine «On Copyright and Related Rights» for libraries associated with the constitutionally guaranteed right of citizens to free access to information and knowledge and the main task of libraries designed to provide for informational, research, educational, cultural and other needs of users Further the author concludes comparing library activities directions with using electronic resources of copyright law that copyright issues arise in all areas of modern library. The author illustrates her conclusions with an example of electronic documents collection of Sukhomlynsky State Scientific and Pedagogical Library of Ukraine which was formed in accordance with current legislation in the form of assemblages. In summary, the author concludes that the current library users need to have information obtaining conditions created to keep the balance of their interests and the interests of authors. The state should consider the benefits of libraries to society and to take steps to change the laws in their favour. Only librarians common position allows to defend users’ rights to information, enhance the role of libraries in the information society.
